La recepción del principio de precaución por el Tribunal Constitucional español. Una propuesta integradora

Abstract
La sociedad actual se enfrenta a amenazas generadas por la acción humana y la tecnología que dificultan la toma de decisiones por parte de las autoridades. El principio de precaución es una herramienta que permite a los poderes públicos tomar decisiones en situaciones de incertidumbre científica sobre los riesgos para la salud humana y el medioambiente. Aunque adoptado en el derecho comparado y comunitario, su recepción por parte del Tribunal Constitucional español es limitada. Para una mejor recepción del principio de precaución, se propone racionalizar su uso, establecer presupuestos claros y límites en su aplicación, y reducir la discrecionalidad de la administración. El principio de proporcionalidad juega un papel importante en este contexto, exigiendo que las medidas adoptadas sean las menos restrictivas posibles para los ciudadanos. En la sociedad actual no existe el riesgo cero por lo que el juicio de proporcionalidad debe estar referido al umbral de riesgo que una sociedad esté dispuesta a aceptar.
