Análisis jurídico-criminológico del stalking a partir de un estudio de sentencias

Abstract

El delito de acoso, más conocido en el mundo anglosajón como stalking, se ha convertido en un fenómeno al alza en la sociedad actual. En España a partir de la reforma del Código Penal aprobada en 2015, los tribunales empiezan a tener conocimiento y a castigar este tipo de comportamientos. El objetivo que se plantea en la presente investigación es analizar una muestra de sentencias dictadas por los tribunales españoles entre los años 2015 y 2018 sobre hechos investigados como conductas de stalking. Se han estudiado un total de 151 resoluciones judiciales (N=151). Los resultados preliminares nos indican que, aproximadamente, el 40% de los casos acaban en una sentencia condenatoria, y que la pena que más se aplica es la prohibición de aproximarse a la víctima (51%). En el 94% de los casos, el stalker es hombre y en el 94% de los casos la víctima es una mujer, existiendo una relación previa entre ambos (74,1%). Los resultados obtenidos son coherentes con la investigación criminológica existente en la materia.

Stalking has become a rising phenomenon in today's society. Since the reform of the penal code was approved in Spain in 2015, the courts began to gain knowledge about it and punish these types of behaviors. The objective of the present study is to analyze a sample of sentences dictated by the Spanish courts between 2015 and 2018 concerning facts investigated as stalking behaviors. A total of 151 judicial sentences have been studied (N = 151). The first preliminary results indicate that approximately 40% of the cases end in a conviction, and that the most frequent penalty is the prohibition of approaching the victim (51%). In 94% of the cases the stalker is a man and in 94% of the cases the victim is a woman, there being a previous relationship between them (74.1%). The results obtained are coherent with the existing criminological research on the topic.
