| ca |
dc.description.abstract | In this article we set out to analyse in what way the Modern legal/political instantiation of natural law is in fact revolutionary, as it does indeed appear to be, but not so much for its form as for its content. How is it that a reiteration of the existence of human natural rights may be deemed more novel than the fact of giving them legal coverage for the first time in History? The modern conception of natural rights that must sustain all the weight of the edifice that Modernity allocates on top of it must necessarily differ substantially in some way from that traditional Aristotelic-Thomist conception, if it is to not succumb under the pressure. Our analysis aims at shedding some light on this phenomenon and in doing so to question whether given our perspective of 300 years and our quite complicated current situation, it is in fact holding up to the test of time. Our concern stems not only from the difficulties in stabilizing the situation of natural rights in today’s world from a theoretical, political and social perspective, but also from the fact that the constant questioning of their legitimation might lead -as has been the case for quite some time now- to a questioning of their existence altogether. | ca |
