El objetivo de este artículo es analizar cómo el proceso jurídico-político moderno de positivización de derechos naturales en apariencia revolucionario por su forma es, en realidad y paradójicamente, revolucionario por su contenido. ¿De qué manera exactamente resulta más novedoso reafirmar la existencia de unos derechos naturales, que el hecho de redactar y protegerlos por ley por vez primera en la historia? La concepción moderna de quienes defienden los derechos naturales ha de diferir substancialmente de la concepción tradicional de raíz aristotélica-tomista, para poder soportar, sin hundirse, todo el peso del edificio que la Modernidad le construye encima. Este análisis pretende arrojar una luz sobre este hecho para terminar por cuestionarse, con la perspectiva que nos dan 300 años y nuestra difícil situación actual, si realmente no se estará hundiendo este edificio. No ya solamente desde el punto de vista de las dificultades teóricas, políticas y sociales por mantener en vigor este difícil equilibrio de derechos, como veremos que lo es, sino teniendo en cuenta que el cuestionamiento de la legitimación moderna de estos derechos está llevando, desde hace tiempo ya, al cuestionamiento de la propia existencia de estos derechos.; In this article we set out to analyse in what way the Modern legal/political instantiation of natural law is in fact revolutionary, as it does indeed appear to be, but not so much for its form as for its content. How is it that a reiteration of the existence of human natural rights may be deemed more novel than the fact of giving them legal coverage for the first time in History? The modern conception of natural rights that must sustain all the weight of the edifice that Modernity allocates on top of it must necessarily differ substantially in some way from that traditional Aristotelic-Thomist conception, if it is to not succumb under the pressure. Our analysis aims at shedding some light on this phenomenon and in doing so to question whether given our perspective of 300 years and our quite complicated current situation, it is in fact holding up to the test of time. Our concern stems not only from the difficulties in stabilizing the situation of natural rights in today’s world from a theoretical, political and social perspective, but also from the fact that the constant questioning of their legitimation might lead -as has been the case for quite some time now- to a questioning of their existence altogether. 2019-01-01T00:00:00Z
