Estrategias de aprendizaje de expresión escrita para estudiantes de Derecho

Abstract
El establecimiento del Espacio Europeo de Educación Superior ha permitido revisar los planes de estudios de titulaciones
clásicas como Derecho para incluir elementos nuevos como las competencias. Este trabajo muestra las estrategias de
aprendizaje de la expresión escrita en dos asignaturas del Grado de Derecho: Técnicas de Comunicación y Filosofía del
Derecho, dentro de un plan de desarrollo de la competencia de comunicación escrita.
En la asignatura Técnicas de Comunicación se parte de la distinción de los niveles del lenguaje, los grados del saber
lingüístico y las valoraciones formuladas por el lingüista Eugenio Coseriu. En el aula se analiza el proceso de la redacción
de un texto y se explican las fases de elaboración del discurso de la retórica clásica. Los ejercicios pretenden que el estudiante
redacte con claridad, precisión y corrección.
En la asignatura Filosofía del Derecho realizamos un ejercicio de simulación jurídica, en que los alumnos tienen que
emitir un informe jurídico sobre un futuro proyecto de ley. Previamente han realizado ejercicios de interpretación de
las normas y el análisis de distintos tipos de argumentación jurídica. Simulan ser miembros del Consejo General del
Poder Judicial. Para la redacción del informe deben seguir el estilo propio de los informes del Consejo. Procuramos que
los estudiantes adquieran la habilidad de utilizar con rigor distintos modos de argumentar, dependiendo de si elaboran
un dictamen, un informe o una sentencia.
The European Higher Education Area opens up the possibility of reviewing the curriculum of traditional courses such
as law to include new elements such as professional competences.
This paper presents different learning strategies in written expression in two courses on a law degree: communication
skills and philosophy of law, within a plan for developing the competence of written communication.
In communication skills, the theoretical foundations are the different levels of language, the levels of linguistic knowledge,
and linguist Eugenio Coseriu’s theory. In the classroom, the process of writing a text is analysed, and the stages
of preparing the discourse according to classical rhetoric are presented. The exercises are designed to help students
write with clarity, precision and accuracy.
In philosophy of law, a simulation exercise is conducted where students are asked to write a legal report on a draft bill.
Previously they have carried out exercises of interpretation of norms and they have analysed different types of legal arguments.
Playing the role of members of the Supreme Judicial Council, they are supposed to follow the style of the
Council’s reports when writing their legal report. We ensure that students acquire the ability to use different modes of
rigorous reasoning depending on whether they are writing an opinion, a report or a sentence.
